Terms of service
Last updated 12 October 2026
These terms cover two things: using this website, and the website services we provide under our plans. If we agree something different with you in writing, for example in a quote or order form, that applies instead for the services it covers.
Who we are
fsapp is a full-service web studio in the UK.
You can contact us at contact@fsapp.co.uk.
Using this website
- The information on this site is general and is not professional advice. We try to keep it accurate and up to date but do not promise it is complete.
- Everything on this site, including the designs, text, code and graphics, belongs to us or our licensors. You may view it and share the address, but you may not copy or reuse it without our written permission.
- Do not misuse the site: do not attack it, try to break into it, overload it, send it spam or use it for anything unlawful.
- We may change, pause or remove any part of the site at any time and we do not promise it will always be available.
Our services and plans
We design and build websites, then host them and look after them every month for a fixed monthly fee. The price of the build, what your monthly plan includes and its monthly price are set out in your quote, and what we agreed at the time you ordered is what applies, even if the website changes later.
The website build is charged separately from the monthly plan, at the price in your quote. Your plan includes the hosting, care, monthly changes and extras listed in your quote. A monthly change allowance covers reasonable edits to existing content and does not roll over from one month to the next. Larger pieces of work, extra pages or new features can be quoted separately.
Prices are in pounds sterling. VAT is added where it applies. Timescales we give, such as “live in 48 to 72 hours”, are estimates and depend on you sending the content and approvals we ask for promptly.
What we need from you
- Accurate information, and the text, images, logos and other material for your site.
- Confirmation that you own, or have permission to use, everything you give us, and that it does not break the law or anyone’s rights.
- Prompt replies to our questions and approvals, because delays on your side move the launch date.
You are responsible for the content and claims on your site. We can refuse to publish material that is unlawful, misleading or harmful.
Paying us
We invoice the build as set out in your quote, and the monthly plan monthly in advance, or take payment by the method we agreed, and payment is due on the date shown on the invoice. If an invoice is overdue we may, after giving you reasonable notice, pause your site’s monthly care and, if it stays unpaid, suspend the site until it is paid. We may charge interest on late business payments under the Late Payment of Commercial Debts (Interest) Act 1998.
Starting and ending the service
Unless your quote says otherwise, plans run month to month with no long minimum term. You can cancel at any time by giving us 30 days’ notice in writing (email is fine). You keep paying until the end of that notice period. Fees already paid for a month in progress are not refunded, unless the law says otherwise.
We may end the services by giving you 30 days’ notice, or straight away if you seriously break these terms, or do not pay after a reminder. If you are a consumer, see “Your consumer rights” below.
Who owns what
You own your content, your branding and your domain name, and we do not claim any rights in them. If you leave, we hand over everything that belongs to you: your content and media, your branding files and your domain, including the transfer or unlock details needed to move it, and we will help you move to a new provider.
We keep ownership of the code, design systems, templates and tools we use to build and run sites, which we also use for other customers. While you are a customer we give you a licence to use your site built with them. If you leave, we can provide your site’s pages and files as they stand, but the underlying tools stay ours.
Where we register a domain, set up a Google Business Profile or other account for you, we will do so in your name or, if that is not possible, hand it over when you leave.
Hosting, support and changes
We keep your site hosted, backed up and up to date. We aim for it to be available all the time, but no website can be guaranteed to never go down, and we are not responsible for interruptions caused by things outside our control, such as problems at a hosting or domain provider, a power or internet failure, or attacks that good security could not have stopped.
Search rankings and results
We build search optimisation (SEO) into your site and keep improving it, but search engines make their own decisions, so we cannot promise a ranking, a number of visitors or a number of enquiries. We make sure nothing technical holds you back.
Third-party services
Your site may rely on services we do not control, such as domain registries, Google, email and payment providers. Their own terms apply to them, and we are not responsible for what they do.
Our responsibility to you
We will provide the services with reasonable care and skill. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit.
Subject to that, and if you are a business: we are not liable for lost profits, lost business, lost data or any indirect or consequential loss; and our total liability to you for everything connected with the services in any 12 month period is limited to the fees you paid us in that period.
Your consumer rights
If you are buying as an individual and not for your business, you have legal rights, including under the Consumer Rights Act 2015, that nothing in these terms takes away. When you buy services online or by phone you can usually cancel within 14 days of the contract starting without giving a reason. If you ask us to start work within that 14 days and then cancel, you must pay for the work we have already done. To cancel, email us.
Personal data
When we handle personal data for you on a site we run, for example enquiries sent through your contact form, we do so only on your instructions and keep it secure, and you remain responsible for being clear with your own visitors about what you do with it.
General
- We may update these terms, and the version on this page when you order is the one that applies to that order. We will give you reasonable notice of changes that affect an existing plan.
- If any part of these terms cannot be enforced, the rest still applies.
- These terms, together with your quote or order form, are the whole agreement between us about the services.
- These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute, although if you live in Scotland or Northern Ireland you can use your local courts.
